On November 18, 2012, Zhejiang Aokang Shoes Co., Ltd., China’s leading shoemaker based in Wenzhou, received from the Court of Justice of the European Union, the EU Supreme Court, a judgment overruling the General Court’s judgment in October, 2010 that had rejected pleas from Aokang. According to the final judgment, Aokang wins the victory against EU’s anti-dumping. As said by Wang Zhentao, president of Aokang Shoes, what they won was not only a lawsuit, but more importantly, the dignity.

“The ruling annuls the regulation of the EU Council imposing an anti-dumping duty on leather shoes originating from China and Vietnam, so by principle the duties paid by importers before are refundable. Meanwhile, the judgment orders the EU Council pay the costs incurred by proceedings both at the General Court and the supreme court.” Said Pu Lingchen, a Chinese lawyer working for Aokang. The litigation costs to be paid to Aokang are estimated to total around five million Yuan.

Though the EU Council terminated its anti-dumping measures against Chinese leather shoes on March 31, 2011, the legal problems in connection with the anti-dumping had not been fully solved before the judgment. The winning of Aokang this time helps with the unsolved legal problems, but also relevant legal basis for Chinese shoemakers’ future countermeasures against anti-dumping, which is of great benefit to Chinese enterprises’ competing in the international market.

“Looking back to our pleas, we think that Aokang has also learned a lot, especially the legal knowledge with respect to international trade and dispute, which will be of great help to our future internationalization.” Said Wang Zhentao, adding that Aokang are making more efforts in promoting its shoemaking technology and product quality. Take its footwear for export as an example, the unit price of their exported shoes has reached more than USD 20, and some even up to USD 50.
